    But as a recent believer in buddhist ideals, I think I will just be a cow in my next life..

    That brings up a good point.. as a cow, it would be a bad life for me in USA.. India would be much better bet.. I would be worshipped and rarely eaten.. hmm.. Thinking ahead of the curve, I think I will apply for a "cow green card" for India.. Cows will be clamouring to get to India.. I will be mooing away soon..

    Based on the knowledge I have.

    1. Can my hospital file for my PERM and subsequently for GC while I am still doing chief residency on cap exempt visa and technically a part of residency program which is cap exempt?

    If it is a profit based company then you are no more cap exempt. You have to file a new H1B asap.

    2. Will i need a new H1b process with the hospital as it has changed from cap exempt to cap status as it is no longer non profit?

    They have to file a new H1B for you.

    3.My prospective employment date will be June 19 2011 as till then I will be working as chief resident, so what would be the earliest date for filing the PERM and H1b application

    GC is for future employment. When they apply for Prevailing wage they have to apply based on your 2011 position (Hospitalist/Teaching Hospitalist/ Primary care doctor). They can file your GC now.

    I recently took up a fulltime job and I was told that drug test will be taken few days before the join date. Also the employment is contegent upon succefull drug test and background test.

    My concern is, I need to give 2 week notice to my present employer . If drug test and background test are not done before 2 weeks of join date, how can I be sure things don't go wrong for some or the other reason in checking. My records are clean in US and I don't forcee any problem.

    SO is this common to conduct drug test few days before join date...??

    Thanks frostrated. When I said CPT I actually meant STEM Extension (17 month). Anyways, if I don't find employment before my OPT expires, can I go to back to school without an issue? I think I should be okay but I just wanted to make sure. I would appreciate it if I got any input on this matter. I need to double check myself to make sure I'm on a legal status


    Yes, you can go back to school. But you also need to find out if you were in violation of your status. On OPT, you cannot stay without working for more than a set period of days.
    Though that is rarely enforced, it is good to keep in mind.
    You can get an OPT only once per degree level. So, if you got your OPT for a master's level program, you cannot get another OPT for a master's level degree. You can get one for the Phd though. So keep that in mind when you go back to school.

    But there are many threads where folks have given their inputs per consultation from their lawyers and have mentioned that EAD "part time" does not invalidate your regular H1 as long as you have continued with your regular H1 employment. Your case is in a grey area.

    Yes, you can renew if your 140 is approved, i have done mine, my H1B was expired and used EAD for 2 months, and again file fresh H1B and got approved and went out of country to get stamp done,

    Peeps -

    My self-filed I-485 application (July 2nd) was sent without:
    - Medical Exam results
    - Employment Verification Letter

    I have recently rec'd the receipt number for my case. Should i sent the missing documentation to USCIS linked to the receipt numbers - or should i wait for the RFE? Anyone with experience with this please advise.

    Secondly, if you recommend that i send it now, how can i make sure that the documents will get added to my file? Is there a special procedure for this?

    I believe its a good idea to wait for the RFE since that would be the right way to go about this.

    Hello,

    My 6 years on H1B is going to expire in Oct 10. I want to file for extension but the lawyer says that i can do it only after Mar 10 that is 6 months before h1b expires.

    I have to visit my home country in May 10 and i wanted to go with my new h1b documents.

    Can you please suggest if i can file now or is there really a timeframe before we file?

    Sorry forgot to mention, I have approved I140.

    I have also had some issues with that too, the "real" thing in living color is spectacular, but when I capture it with the camera, it loses it's effect. Just wanted to let you know that your not alone on this one.

    Hi all IV gurus,

    My wife and I filed our I-485, EAD and AP on July 12th and the package arrived in NSC on July 13th. We have received all receipts and finished our FP about 10 days ago. I checked the online status and there are NO LUDs on any of our applications. All of them still show the ND of August 15th. I am EB3 ROW with PD Jan07. My I-140 is still pending at NSC.

    My wife is currently on H-4 and she would like to work. Is she able to apply for a temporary EAD on October 15th, since it will already be 90 days since RD? If yes, how do we go about doing that?

    Your experience and advice are very much appreciated!

    Has anyone requested premium processing of I-140 based on expiry of the sixth year of H1B. My 6th year H1B expires next month and I think I am eligible for premium processing.

    You are eligible only if there is *no* other way of extending your H1-B. If your labor certificate is more than 1 year old, then you are not eligible. In that case you can get 1 year extension based on the LC.
